Terms and Conditions

Our terms and conditions, returns policy and deliveries  will apply to all purchase of our product/s from the ᴂshah  website and form a legally binding contract between you and ᴂshah. Your acceptance of the terms and conditions is given when you purchase goods from us.

The terms and conditions may change throughout time. Access to this website is permitted on a temporary basis, and we reserve the right to withdraw or amend our services without notice. We will not be liable if for any reason this Website is unavailable at any time or for any period.

You are responsible for the confidentiality of your login details, password and all other information provided.

If for any reason, important information relating to the handling and care of your product is missing, i.e wash care labels, woven labels, etc, please email aeshahscot@gmail.com to request for this information. We cannot be held responsible for any act undertaken by the customer without consulting ᴂshah which may result in damage to the product/s due to not following care instructions and guidelines normally present on each item’s wash care label.

Products

Please consider that buying products over the Internet provides a different shopping experience to buying in-store. We have made every effort to display as accurately as possible the colours of our products. However, as the actual colours you see will depend on your monitor settings, we cannot guarantee that your monitor’s display of any colour will accurately reflect the colour of the product on delivery and we cannot be held responsible for differences which appear as a result of the aforementioned point. All measurements are approximate,  but every effort is made to ensure they are as accurate as possible. Unless otherwise stated, sizes indicated are UK sizes. Please refer to the Size Guide for clarification.

We will take all reasonable care to ensure that all details, descriptions and prices of products appearing on the website are correct at the time when the relevant information is entered onto the system.

Please also note due to the nature of manufacturing, all lengths stated are approximate and variations of/up to 1 inch may occur.

However, if we discover an error in the price of any goods that you have ordered, we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel, and you have already paid for the goods, you will receive a full refund.

Our Contract

When you place an order, you will receive an acknowledgement e-mail confirming receipt of your order: this email will only be an acknowledgement and will not constitute acceptance of your order. A contract between us will not be formed until we send you confirmation by e-mail that states the goods that you have ordered have been dispatched to you. Only those goods listed in the confirmation e-mail sent at the time of dispatch will be included in the contract formed.

Payment Method

We accept payments from all major debit and credit cards. All transactions are securely processed via PayPal. You can use your PayPal account for the payments or your card details. PayPal is the most secured payment method for online payments. Please note that ᴂshah  do not/cannot store any debit/credit card information.

Prohibitions

You must not misuse this Website, commit or encourage a criminal offence; transmit or distribute a virus, trojan, worm, or post any other material which is malicious, technologically harmful, in breach of confidence or in any way offensive or obscene; cause annoyance to other users; send any unsolicited advertising or promotional material. ᴂshah will report any such breach to the relevant law enforcement authorities and disclose your identity to them. We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of this Website or to your downloading of any material posted on it, or on any website linked to it.

ᴂshah reserves the right to close accounts if any user is seen to be attempting to disrupt our services in any way.

Ethical Sourcing Policy

ᴂshah recognises its obligation to ensure that suppliers are operating ethically. We expect our suppliers to consistently provide an environment that protects their employees health and safety and basic human rights. All suppliers are expected to comply with their national employment laws and regulations

Our Returns Policy

All returns are processed in order of arrival. Once received, a return may take up to 14 working days to be processed or more during busy and sale periods.

If you have not heard from our returns team within 10 working days of your parcel being delivered, please contact aeshahscot@gmail.com (you may use the contact form to send a direct message).

For peace of mind, if you returned your parcel using a tracking service, kindly check the tracking number provided by the postal service provider, to find out if your parcel has been returned; our returns team do not send notifications to customers to inform them we have taken receipt of a parcel.

Customers will receive an email notification once their return has been processed (please check your Spam/Junk folder for this automated message). Kindly note, once a refund has been completed by ᴂshah; the time frame it can take to appear in your bank account will depend on your bank’s policy. As a general guideline, funds may take up to 10-14 days to appear in your account once a refund has been issued.

We will only offer an exchange or refund for clothing within 28 days of purchase, with proof of purchase (receipt) and if the garment/s is/are unused, unwashed, in perfect resalable condition with the ᴂshah Swing Tag(s) still attached. We cannot accept returns that have been TORN, SOILED or DAMAGED due to INCORRECT WASHING or use.

To return an item, please complete the returns form on your delivery note marking the items you are returning, the reason code for returning it and what you would like in exchange or if you request a refund. Enclose the completed returns form with the items you are returning. If you require a replacement return form please contact us and we will send a new form to you via email. Goods returned to ᴂshah will be at your own expense. We will send your exchange item to you by Recorded Delivery with no extra charge.

You may use any shipper you like, but we recommend purchasing tracking and insurance, as we cannot be responsible for lost return shipments. ᴂshah will not refund any goods that have either been signed for by someone other than the customer at the delivery address stated on the original order or for items returned to us which are lost in the post and are not accompanied by a tracking number.

Your refund will be issued according to the payment method you selected for the original order. Shipping fees are non- refundable. International customers are advised that ᴂshah will not refund any charges/tax you may incur when returning goods. Refunds will be authorised only after a full inspection of the goods by our Returns Department.

We will usually refund you what you paid for the goods but not the delivery charge except in cases where the order was cancelled before the item was shipped out or if the entire order was faulty.

As soon as your return has been processed, you’ll receive an email confirming your exchange or the amount refunded back to you. In the unlikely event that you don’t receive this email within 14 days of posting your parcel to us, please get in touch with our Customer Care Team and we’ll get back to you.

Exchange Requests

All requests for an exchange will be subject to availability.

International Customers

If you are returning item(s) to us from outside of the EU, you must complete customs declaration, clearly stating that the package contains ‘RETURNED GOODS’. If your parcel is stopped at UK Customs and a charge levied, we will refuse payment and the package will be returned to the sender. Under no circumstances can ᴂshah pay customs duty in order to receive back our items. Please note, major couriers may charge administration handling fees for returning goods; under no circumstances can ᴂshah pay such fees, this will be deducted from the refund amount requested.

When trying on items of clothing, please ensure that you are not wearing perfume, make-up or deodorant which may leave a scent or mark on the item.

Shipping Services

1. UK Customers

Please select Royal Mail “1st and 2nd Class Signed For” service. This can be tracked on Royal Mail website. Once an item is shipped, ᴂshah sends customers their tracking information by email.

2. International Customers

Please select Royal Mail ” Tracked & Signed ” or Without Tracking service. The ” Tracked & Signed ”  service can be tracked on Royal Mail website. Once an item is shipped, ᴂshah sends customers their tracking information by email. “Without Tracking” service is a cheaper option, however, it does not let one track an item over internet. Please note that ᴂshah will not be responsible for items lost through “Without Tracking” service.
